We routinely see clients with a suspended license for a wide variety of reasons. Often a client will come to me not knowing that they had a suspended license until a traffic stop was initiated and they were charged with driving on a suspended license. There are so many factors that could suspended someone's license from failure to pay child support to being convicted of vehicular homicide.
Generally, my recommendation is immediately upon an arrest for driving on a suspended license is to get started on the process necessary to have your license reinstated.
Below are the penalties an individual would face for a conviction under O.C.G.A. § 40-5-121
The dates for sentencing purposes are measured from arrest date to arrest date.
Penalties if Convicted of Driving With a Suspended License

1st in 5 years
- Not less than 2 days in jail nor more than 12 months. There can be an additional fine amount of not less than $500.00 and no more than $1,000.00. A six month license suspension with a $210.00 reinstatement fee.

2nd or 3rd in 5 years
- Not less than 10 days in jail nor more than 12 months. There can be an additional fine amount of not less than $1,000.00 and no more than $2,500.00. A six month license suspension with a $310.00 reinstatement fee for a 2nd conviction and a fee of $410.00 for a 3rd conviction.

4th or more in 5 years
- Not less than 1 year in jail nor more than 5 years. There can be an additional fine amount of not less than $2,500.00 and no more than $5,000.00. A six month license suspension with a $410.00 reinstatement fee.
